- Because fetal viability to exist on its own is not until 19-21 weeks of gestation, abortion must be exercised before this time frame. After that, it is murder. The ability to feel pain by a fetus is very unlikely before 20 weeks; fortunately a similar date of gestation.
I leave it to the woman to decide what to do in cases of rape or incest (or any pregnancy), but she has to make her choice and implement it before, say 20 weeks of gestation.
