On April 8, 2015, Rayhons began his trial for allegedly sexually assaulting his wife while she was living in a nursing home. He was charged with sexual abuse in the third-degree and could have served up to 10 years if found guilty. Rayhons and his wife, Donna Lou, were married for seven years, before she died last August. The charges were filed days after she died. Last year, Rayons' wife was moved to a nursing home because she was suffering from dementia and Alzheimer's. The staff of the nursing home told Rayhons that his wife was no longer mentally capable to consent to sex, but Rayons ignored that message. State prosecutors had to prove whether Donna Lou was able to give consent or not. Iowa law defines an act as sexual abuse in the third-degree if the two people who are married are not living together and if one person "is suffering from a mental defect or incapacity which precludes giving consent." On April 22, 2015, Rayhons was found not guilty of sexually abusing his wife.
