Caputo was charged with misdemeanor battery after he charged through the door to the House chamber and injured a doorkeeper. He was also accused of pushing a delegate out of his way. The charges were later dismissed. “I have already apologized for losing my temper that day, but I certainly didn’t intend to physically hurt anyone and don’t believe I committed a crime,” Caputo said. Caputo made an initial court appearance on September 30, 2019. On December 5, 2019, Caputo's lawyer filed a motion requesting legislative immunity. "[Caputo] was trying to enter the House chamber in an effort to carry out his privileges and obligations as a member of the House of Delegates,” the motion stated. “Because this legislative act committed within the legislative sphere is statutorily protected activity, [Caputo] cannot be prosecuted criminally based on allegations made in the criminal complaint.” On January 27, 2020, Judge Tod J. Kaufman dismissed the charges against Caputo on the grounds of legislative immunity. Kaufman wrote in the ruling, "[The] defendant was trying to enter the House chamber in an effort to carry out his privileges as a member of the House of Delegates. Because this legislative act committed within the legislative sphere is statutorily protected activity, defendant cannot be prosecuted criminally and will be shielded from the issuance of extraordinary writs with respect to his legislative acts."
