On December 5, 2018, Ascencao announced he would not take his seat in the Rhode Island House of Representatives after admitting to lying to local town council candidates about producing a six-page mailer. According to WPRI, Ascencao said he created the mailer but did not finish it in time for it to arrive before the election on November 6. He also created a fake invoice as evidence he completed the task. "Instead of coming clean and admitting that I had been unable to complete the mailer, I told them it had gone out. ... In reality, at no point was any expense accrued, any order placed, or any check mailed," he said. Ascencao faced calls to step down from groups such as the Warren Democrats and the Rhode Island Coalition Against Gun Violence.
