On October 11, 2016, Marten was arrested and charged with "five counts of first-degree sexual assault, three counts of third-degree sexual assault and endangering the welfare of a minor." He is accused of sexually assaulting a female family member, who was between the ages of 7 and 10 at the time. Marten was released from jail after posting $650,000 bail in May 2017. In August 2019, he pleaded no-contest to endangering the welfare of a minor to the first degree. Marten was sentenced to five years in prison on January 29, 2020.
