On October 2, 2020, Cunningham admitted to sending inappropriate sexual texts to Arlene Guzman Todd, a woman who was not his wife. The text messages were originally published on October 1 of the same year by National File. Cunningham said in a statement: "I have hurt my family, disappointed my friends, and am deeply sorry. The first step in repairing those relationships is taking complete responsibility, which I do. I ask that my family’s privacy be respected in this personal matter."
